The Indian government announced a complete overhaul of colonial-era criminal laws. It is mainly for crimes like mob lynching and rape of minors, and a new crime of threatening unity instead of sedition.

A new crime for acts of secession, armed rebellion, subversive activities, and endangering the unity and integrity of India has been added to the new laws.

India’s Union Home Minister Amit Shah said that the Indian Penal Code of 1860 will be replaced by the Bharatiya Nyaya Sanhita.

He introduced the three bills in the Lok Sabha. The Bharatiya Nagarik Suraksha Sanhita will replace the code of criminal procedure, and the Bharatiya Sakshya will replace the Indian Evidence Act.

All three laws were sent to the standing committee for review. Amit Shah said that the sedition law has been repealed and is replaced by Act 150 for acts endangering the sovereignty, unity, and integrity of India.

Amith Shah stated that whoever purposely engages in armed rebellion, subversive activities, or endangering unity and integrity is punished by Act 150.

Punishments as per Section 150

The person committing the above crime shall be punished with imprisonment for life or with imprisonment for seven years and shall be liable to a fine under Section 150.

In the punishment for little crime, it is the first time adding community service.

The New Bill’s priorities and Punishments for offenses

The new bill prioritizes the law for crimes against women and children, murders, and offenses against the state.

The law says that those evading arrest can be tried in their absence.

The police should furnish updates on offenses in the FIR first within 90 days, and they have permission to file an E-FIR from anywhere.

The prosecution process for a crime—search, and challan has to be videographed.

The law suggests that people who vote by taking money at election time are punished with one year in jail.

20 years in jail to life term punishment for gang rape criminals.

There is no change in the death sentence in these New Bills.

Amit Shah told Parliament it seeks to revive British-era law.

Which Laws were replaced by the New Bills?

  1. The CrPC of 1973 will be replaced by the Bharatiya Nagarik Suraksha Sanhita of 2023.
  2. The Indian Evidence Act of 1872 will be replaced by the Bharatiya Skshya Bill of 2023.
  3. The Indian Penal Code Would be replaced by the Bharatiya Nyaya Sanhita of 2023.
