
Appeals Court Temporarily Lifts Gag Order on Former President Donald Trump
NewYork, Nov 4: A Washington appeals court has temporarily lifted the gag order placed on former President Donald J. Trump in the federal case against him, which accuses him of attempting to overturn the 2020 election. This decision allows Mr. Trump to resume criticizing the prosecutors and witnesses involved in the case for the time being.
US Court Temporarily Stays Trump Gag Order In 2020 Election Case
In a brief order, a three-judge panel from the U.S. Court of Appeals for the District of Columbia explained that this temporary pause, lasting approximately two weeks, would grant them sufficient time to decide on a longer suspension while they consider the more significant question of whether the original gag order was rightfully imposed.

The panel’s ruling came in response to an emergency request filed by Mr. Trump’s lawyers on Thursday night, seeking to lift the order while the appeal is ongoing. While the judges, all of whom were appointed by Democrats, have temporarily halted the gag order until at least November 20, they emphasized in their decision that this should not be interpreted as a ruling on the merits of Mr. Trump’s broader motion for an extended suspension.
The gag order was initially implemented by Judge Tanya S. Chutkan in Federal District Court in Washington last month. It has been frozen, reinstated, and frozen again, leading to a prolonged legal battle between two opposing views of Mr. Trump’s actions.

Prosecutors working on the case have repeatedly argued that Mr. Trump’s posts on social media, which often contain aggressive language aimed at people involved in the election subversion case, have had real-world consequences. They portray him as a serial abuser of social media.
In contrast, Mr. Trump’s lawyers have claimed, without providing evidence, that Judge Chutkan’s order is an attempt by President Biden to silence his chief opponent in the 2024 election as the campaign season heats up. They argue that the order infringes on Mr. Trump’s First Amendment rights to express his view that the criminal prosecutions brought against him are politically motivated.

The recent temporary lifting of the gag order has raised the possibility that Mr. Trump may resume posting threatening messages that violated the original restrictions imposed by Judge Chutkan. The order had prohibited him from targeting members of the court staff, the special counsel Jack Smith, his staff, or potential witnesses in the case.
In the past, when the gag order was briefly lifted, Mr. Trump wasted no time in making critical comments about Mr. Smith and appeared to target his former White House chief of staff, Mark Meadows, who could be called as a witness in the case.
